Our Privacy Policy

  1. Who we are?

    Burbank is a home building company that offers single storey and double storey homes, as well as house and land packages. Burbank has been building quality homes since 1983.

    Burbank is part of the Burbank Group, which consists of several business and includes our Affiliates. Our Affiliates are plumbers, electricians, project managers, land developers, resorts business, mortgage brokers, information technology service providers, aviation service providers and storage business providers - among others.

  2. What this policy is about

    In the course of providing our products and services to you, we may need to collect, hold, use and disclose your Personal Information. We understand how important it is to protect the privacy of your Personal Information. Burbank is committed to protecting the privacy of your Personal Information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

        

    The purpose of this Policy is to inform you about:

    • what kinds of Personal Information we collect and hold about you;
    • how your Personal Information is collected;
    • how your Personal Information is held;
    • why we collect, hold, use and disclose your Personal Information;
    • when we may disclose your Personal Information;
    • if we are likely to disclose your information outside Australia and, if practical, which countries they are likely to disclose the information to;
    • how you can access, correct or update any Personal Information we hold about you; and

    Burbank means Burbank Australia Pty Ltd ACN 007 099 872, our related corporate bodies, subsidiary corporate bodies and our Affiliates;

    Contractors means the third parties that we engage, to provide us with goods or services, such as but not limited to The Pistol, Campaign Monitor Pty Ltd, LivePerson, Jago, Headline PR, Australian Finance Group.

    Personal Information means any information or an opinion about an identified individual, or an individual who is reasonably identifiable whether the information or opinion is:

    • true or not; and
    • recorded in a material form or not;

    Policy means this privacy policy;

    We, us and our means Burbank; and

    Website means www.burbank.com.au.

  4. Who this policy applies to

    This Policy applies to:

    • our customers;
    • any person enquiring about our products and services;
    • any person using our Website;
    • any person entering our display homes or any other premises that we trade from;
    • any third party that we trade with, such as our suppliers, Contractors and sub-contractors;
    • our employees and sub-contracted staff; and
    • any person that applies to be employed by us.
  5. Information we may collect and hold about you

    The types of Personal Information we collect and hold about an individual will depend upon the nature of our interaction with them. Personal Information that we collect and hold includes (but is not limited to) the following:

    1. (a)  your identification information, such as your name, age, date of birth, gender. We can also view, make a copy and keep a copy of your identification, such as your driver’s licence, passport, birth certificate, birth extract, citizenship certificate, permanent residency documentation, marriage certificate, change of name certificate, divorce certificate and bank cards;
    2. (b)  your contact details, such as your address (including postal address), telephone numbers (landline and/or mobile) and email address;
    3. (c)  information about your home or property ownership status and preferences (including details of land you want to build on);
    4. (d)  property and title information from our searches or from your contract of sale;
    5. (e)  payment details, such as your credit card or bank account details;
    6. (f)  information about your ability to pay us for our products and services, such as details of your assets and liabilities, tax returns, income details, account balances and activities, employment details and history, rental details, confirmation of finance approval from your bank or credit provider or broker;
    7. (g) credit information such as your credit history, information about existing and previous credit accounts and loans, repayment history, any defaults and credit eligibility information which reflects your suitability for a loan;
    8. (h) insurance information;
    9. (i) occupation and employment details, including employment status and any previous work experience;
    10. (j) your employment history, educational background and any other information set out in or connected with your resume or job application;
    11. (k) educational details and school contact details in relation to work experience students;
    12. (l) emergency contact/parent or guardian/next of kin details (as applicable);
    13. (m) work methods and details, including details about safe work methods (SWMs) and trade qualifications in relation to any person that works on our sites;
    14. (n) trade references, credit references or reports from any third party;
    15. (o) financial information about our Contractors, suppliers or subcontractors;
    16. (p) your opinion or preferences about our products or services;
    17. (q) information about your computer and online usage, including the date and time you access the Website, the domains from where you visited the Website, your online activities, and IP address, which information may be collected through the use of cookies, your use of our Website or the use of our wi-fi services;
    18. (r) information about your movements and location collected by your use of Bluetooth surveillance; and
    19. (s) any other information we are required to collect by law.
  6. How and when we collect Personal Information
    1. 6.1 Where it is reasonable and practicable to do so, we collect your Personal Information from you directly in a number of circumstances, including but not limited to:
      1. (a) when you make an enquiry or request information about our products or services on our websites or over the phone;
      2. (b) when you visit or fill in a form on our Website or the website of our Affiliates;
      3. (c) when you otherwise contact us by telephone, fax, email, social media, by mail or in person;
      4. (d) when you visit one of our display homes or premises from which we operate;
      5. (e) when you provide information to us in any way (including by completing a manual or online form, disclosing information over the phone or via email, or providing us a business card);
      6. (f) when you use or buy our products or services;
      7. (g) when you attend an event hosted by us;
      8. (h) when you provide feedback to us;
      9. (i) when you register your details with us;
      10. (j) through our social media pages;
      11. (k) when you apply for employment with us;
      12. (l) when you (or your employer) provide that information to us in the course of conducting or administering our relationship with you, or when you are carrying out activities in connection with our business operations;
      13. (m) when you provide us, or you offer or apply to supply us, with goods or services; or
      14. (n) where we are otherwise required or authorised by law to do so.
    2. 6.2 Depending on the product or service we provide to you, we may collect your Personal Information from third parties, including but not limited to:
      1. (a) your spouse, interpreter or appointed attorney;
      2. (b) your lawyer, accountant, financier, professional adviser, or other authorised representative;
      3. (c)sales agents or real estate agents;
      4. (d) a bank, credit provider, financial service provider, mortgage broker or credit reporting body;
      5. (e) recruitment agencies or employment service providers;
      6. (f) third party websites that advertise our products and services and allow you to request further information from us;
      7. (g) market research companies,
      8. (h) Titles Office or ASIC;
      9. (i) publicly available sources of information, or
      10. (j) our Contractors,

      but we will only collect your Personal Information in this way if it is unreasonable or impracticable to collect this information directly from you or if we are otherwise permitted to do so.

    3. 6.3 Information from your usage of our Website

      We may also collect your Personal Information from your usage of our Website. When you read, browse or download information from our Website, we may collect information such as the date and time you visited, the duration of your visit, the pages accessed, your IP address and any information downloaded. This information, also known as click stream data, is used for statistical, reporting and website administration, maintenance and improvement purposes only and will not be used to identify you.

    4. 6.4 Cookies

      A cookie is a string of information that a website stores on your computer, and that your browser provides to the website each time you return. These cookies help us to identify and track visitors of our Website, their usage of the Website, and their Website access preferences. We use cookies to display personalised content, appropriate advertising and store your preferences on your computer. The information collected about you from any cookies may be used to assist us with website traffic management and marketing data analytics.

      You may set your browser to accept, disable or notify you when a cookie is sent. If you disable cookies, you may not experience optimum performance of our Website.

    5. 6.5 Wi-Fi Services

      We have Wi-Fi services available to individuals that visit our display homes and premises from which we operate. If you connect to our Wi-Fi network, we may collect information about you, such as your name, phone number, email address and details of the websites you access while you are connected to our network.

      We also use technology in our display homes and premises from which we operate that tracks foot traffic through our display homes by uniquely identifying mobile phone signals.

      If you do not consent to our collection of this information, you can opt-out by not connecting to our Wi-Fi network or turning off your Wi-Fi when entering our premises.

  7. How we hold Personal Information

    We take reasonable steps to protect your Personal Information from misuse, interference and loss and from unauthorised access, modification or disclosure.
    We may hold Personal Information in both hard copy and electronic forms in secure databases on secure premises. The information can only be accessed by those who have a legitimate business purpose and reason to do so. The secure databases are operated either by us or by our external service providers and we have implemented a range of security measures, including strict confidentiality agreements, passwords, firewalls and encryption to restrict access.
    There are risks of unauthorised access associated with using the internet. We cannot guarantee the security of your Personal Information if it is transmitted via the internet. If you use the internet to send us Personal Information, including your email address, it is sent at your own risk. Once we have received your Personal Information, we will endeavour to protect your Personal Information and to prevent unauthorized access.

  8. Why we collect, hold, use and disclose your information

    We collect, hold, use and disclose your Personal Information to:

    • identify and communicate effectively and efficiently with you when we:
      • respond to queries you may have about our products and services;
      • enter into and administer a contract or other agreement with you;
      • provide you with information that we believe may be of interest to you or that you may be interested in receiving, including advertising material, regarding us, products and services, our projects, our clients, and our business partners;
    • run and manage our business operations efficiently and effectively, when we:

      • arrange for our Contractors, sub-contractors and suppliers to provide products and services to you;
      • put you in contact with the mortgage consultants of National Pacific Finance Pty Ltd who may be able to assist you with your home loan needs;
      • engage Contractors, sub-contractors or suppliers;
      • collect and process payments and invoices;
      • carry out credit checks and credit reporting where you or your business are seeking to use a credit facility;
      • manage and administer any account you may hold with us;
      • for business support purposes including any maintenance, backup and audit;
    • improve our products and services by:
      • conducting product and market research;
      • creating new ones
      • personalising our products and services or those of our Contractors, sub-contractors and suppliers;
      • helping us to manage and enhance goods and services we procure from our Contractors, suppliers and sub-contractors;
      • monitoring your usage of our Website;
    • market our products and services to you and to:
      • better understand your requirements and preferences and the market trends;
      • personalise and improve our service and to provide offers that are of greater interest or benefit to you;
      • conduct customer satisfaction surveys in respect of our products and services;
      • undertake and administer promotions, competitions, events, marketing activities, direct marketing, database compilation, analysis of trends and demographics and other marketing or promotional activities with respect to our products and services;
    • for recruitment or employment reasons, namely to:
      • recruit and assess future employees;
      • maintain and update our records;
      • review and assess job applications;
      • provide a safe and secure workplace and premises for you, our staff, workers, trades, suppliers and our visitors; or
    • comply with our statutory and legal obligations.
  9. To whom we disclose your Personal Information

    In order to run our business and to provide you with our products and services, we need to work with, and we may need to share your Personal Information with third parties. Accordingly, we may disclose your Personal Information, and you consent to Burbank disclosing your Personal Information, to:

    1. (a) our related and subsidiary bodies corporate and associated entities (as those terms are defined in the Corporations Act 2001 (Cth));
    2. (b) our Affiliates and in particular, National Pacific Finance Pty Ltd, to contact you about the provision of its mortgage brokering services to you;
    3. (c) our employees, internal business divisions, business units or departments;
    4. (d) our Contractors, agents, sub-contractors, consultants and suppliers;
    5. (e) other builders and their housing consultants;
    6. (f) auditors and financial advisers;
    7. (g) building surveyors, engineers and other consultants that we engage;
    8. (h) responsible authorities, such as local councils and water authorities;
    9. (i) the Land Titles Office, State Revenue Office, relevant State and Territory Valuers General, Australian Securities and Investment Commission;
    10. (j) real estate agents and sales consultants;
    11. (k) guarantors and other security providers;
    12. (l) valuers;
    13. (m) financiers, potential financiers, credit reporting bodies,
    14. (n) financial institutions and credit providers for the processing of payments and invoices;
    15. (o) referees whose details are provided to us by job applicants or tenants;
    16. (p) our professional service providers or advisers, such as lawyers or accountants;
    17. (q) medical professionals for assessing insurance claims;
    18. (r) any court, tribunal or industry body;
    19. (s) other organisations or individuals who assist us in providing products and services to you, including for the maintenance of your home;
    20. (t) any service or utility provider that we engage on your behalf;
    21. (u) law enforcement agencies, other governmental agencies or any other parties if we are required by law to do so, or in other limited circumstances (for example if required by a court order or regulatory authority, or if we believe that such action is necessary to prevent fraud or cyber-crime or to protect our website, our products or our technology assets or the rights, property or personal safety of any person); or
    22. (v) any other party as required or authorised by law.
  10. Overseas disclosure

    Some of your Personal Information may be disclosed, transferred, stored, processed or used overseas in India by us, our Affiliates or by a third party service providers for the following reasons:

    1. (a) we outsource certain activities (such as drafting and administrative support) to our Affiliates; and
    2. (b) transactions, information, services or products have an overseas connection.

    We will take reasonable steps to ensure the overseas recipient complies with the APPs or is bound by a similar law before we disclose your Personal Information overseas.

  11. Your consent to us

    You consent to the collection, storage, use, disclosure and transfer of your Personal Information in accordance with this Policy by:

    • providing us with your Personal Information;
    • using the Website; or
    • entering into a contract or other agreement with us.

    By using our Website, you also consent to our use of cookies in accordance with this Policy.
    Your consent will remain current until you advise us otherwise. However, you can withdraw your consent or opt out at any time, by:

    • contacting us in one of the ways set out in paragraphs 15; or
    • using the unsubscribe facility that we include in our electronic messages (such as by email and SMS).

    If you choose not to provide your Personal Information to us for the purposes set out in this Policy, or if we do not, or are unable, to collect the Personal Information we require, or if you withdraw your consent, we may not be able to provide you with requested information, products or services, or to transact with you.

    We may review and amend this Policy at any time. All Personal Information collected, held, used and disclosed by us will be governed by the latest version of this Policy posted on this Website. If we decide to amend this Policy, we will publish the updated version on our website. You should check this Website from time to time to check for any amendments to this Policy.

  13. Accessing and correcting your information we hold

    We rely on accurate and reliable information you supply to us in order to provide our products and services and to otherwise run and manage our business operations. We take all reasonable steps to ensure that any Personal Information we collect, hold and use is accurate, complete and current.     You are entitled to request access to your Personal Information. We will endeavour to give you access to your Personal Information to the extent required or authorised by the Privacy Act or other law and provided it does not compromise the privacy of another party.

    Before we give you access to your Personal Information:

    • you must provide us with proof of your identity. This is to make sure that Personal Information is provided only to the correct individuals and that the privacy of others is protected;
    • we require you to be reasonably specific about the information you require; and
    • we may charge you a reasonable administration fee, which reflects the cost to us, for providing access in accordance with your request.

    We will endeavour to respond to your request to access or correct your personal information within a reasonable time of receiving our request and no later than 30 days from your request.

BURBANK MARKET RESEARCH SURVEY COMPETITION – TERMS & CONDITIONS

Conditions of Entry
  1. Participation in this promotion is deemed acceptance of these terms and conditions.
  2. Participation in this promotion is deemed acceptance of the Burbank General Terms & Conditions.
  3. The Promoter is Burbank Australia Pty Ltd, ABN 91 007 099 872 located at 36 Aberdeen Road, Altona VIC 3018 (Promoter).
  4. This offer is open to all Australian residents. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated with this Promotion are ineligible to enter. Participants under the age of 18 must first seek permission from their parent or legal guardian.
  5. The competition commences on Tuesday 03/05/2022 at 9.00am AEST and concludes on Sunday 31/07/2022 at 11pm AEST (promotional period).
    How to enter
  6. To enter, the person must:
    • Complete all required questions within the survey
    • Fill out all contact details
  7. The winner will be selected by a random number generator of all valid entries at the end of the competition period.
  8. The winner/s will be notified on the competition post within forty-eight (48) hours of their entry being chosen.
  9. If the prize is not claimed by 12:00pm on Thursday 04/08/2022 the winner's entry will be deemed invalid and the Promoter reserves the right to draw a further winner on 05/08/2022 at the same location as the original judging as are necessary to distribute the prize.
  10. If any redrawn prize is not claimed by 09/08/2022 the prize will be forfeited.

The prize (including any unused portion of the prize) cannot be assigned, transferred, redeemed for cash, or substituted except by the Promoter who may at their sole discretion, subject to the relevant state authorities, substitute any prize with one of comparable value if the advertised prize is or becomes unavailable for any reason. The Promoter will not replace any lost or stolen prizes, or take responsibility for any broken products in the delivery of the product or after it has been delivered. It is not the responsibility of the Promoter to insure any products.

Entrants consent to the Promoter using the entrant’s name, likeness, image, entry and/or voice in the event that they are a winner (inc. photograph, film, and/or recording of the same) in any media for an unlimited time without notice or remuneration for the purpose of promoting this competition.

To the extent permitted by law, the Promoter (including its officers, employees and agents) and its associated agencies and companies will not be liable for any loss (including, without limitation, direct, indirect, special or consequential loss, or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this promotion or accepting or using any prize.

30 year structural guarantee

♦ 30 year structural guarantee applicable to deposits made from 1 February 2011. Burbank provides the original owner of the works with a 30 year structural guarantee from the date of certificate of occupancy. This structural guarantee is not transferable and not provided to any subsequent purchaser. Any structural defect caused by one or more of the following events are not included in the structural guarantee: storms, fire or flooding; trees growing near the footing system of the works; fair wear and tear; misuse or neglect by the owner; the owner’s failure to maintain the works; movement due to shrinking evidenced by minor cracking; the owner’s failure to maintain termite protection; any structural modification/s made to the existing home after handover will void the 30 year structural guarantee. The original owner acknowledges receipt of CSIRO “Foundation Maintenance& Footing Performance” information document and agrees to comply with its terms and conditions.

6 Months Price Freeze Guarantee

The 6 month price freeze commences on the date of the initial deposit date until:

    1. The registration of the title (being receipt of Property Service Information) or

    2. Demolition works (being receipts of Asbestos Clearance Certificate) or

    3. Planning permits (being receipt of endorsed plans)

If all of the above is not completed within 6 months, Burbank is entitled to issue a price rise. If your title is registered and / or no planning and no demolition is required, the price freeze does not apply as you will receive priority status.

Burbank Customer Review Competition

Terms and Conditions

The “Burbank Customer Review” competition is promoted by Burbank Australia Pty Ltd ABN 91 007 099 872 (“Burbank”).

To enter into the competition, entrants must submit a review of Burbank on Google or Product Review between March 1st 2022 and May 31st 2022; June 1st 2022 and August 31st 2022 or September 1st 2022 and November 30th 2022, December 1st 2022 and February 28th, 2023. By entering into the competition, the entrant will go into the draw to win a $1,000 Prezzee E-Gift card. Reviews received outside these dates will be ineligible for the competition.

The competition is open to all Australian citizens over 18 years of age and who have purchased a home with Burbank. The prize cannot be redeemed for cash or goods.

The winners will be selected randomly and drawn at Burbank’s national head office located at 36 Aberdeen Road, Altona and the winners will be notified within three (3) business days from the draw date. Burbank reserves the right to ask the winner to prove their identity by seeking identification documents from them.

There will be four (4) winners in total and each will receive $1,000 Prezzee E-Gift card drawn quarterly on the dates below and subject to the terms and conditions stated above:

Fixed Site Cost

^ Site costs not included in the Quotation (unless otherwise noted in the Quotation): homes with nonstandard footprints; slab classifications other than ‘M’; concrete slab engineering requirements (under pinning, deepened edge beams, screw piles); bored concrete piers greater than 450 diameter and/or 1200mm deep; permanent boundary fencing; removal of rubbish (including but not limiting car bodies, dumped soil, demolitions); septic tanks or other below ground storage systems (not discovered during site inspections); re- establishment surveys by licensed surveyors; tree removal and or tree root barriers/protection; retaining walls other than sleeper construction or garage boundary wall; council and regulatory requirements (including but not limiting crossover protection, bushfire; protection, salinity areas); areas requiring high wind requirements; electrical connections other than to pit at front of property; gas connection greater than 30 linear metres from home; sewer and stormwater connection outside property boundary; crossover construction or relocation; sites with greater than 2000mm fall; sites where conditions vary from developer construction plan; sites where a drive gradient of 1 in 6 cannot be achieved with 1 step down to garage; setbacks greater than 6 metres; restricted/steep site surcharges; retaining walls and AG drains associated with retaining walls; vegetation removal greater than 150mm in height; job specific preliminaries, additional survey details, effects from facade or structural variations; HSE requirements - over depth sewer tie and fall protection (including but not limited to traffic; management/tight and difficult site access/hazardous materials); surcharges for exclusion zones (exclusion zone - 15km radius from Melbourne GPO), established areas and areas outside Burbank building zones.

Guaranteed Site Start

Guaranteed site start applicable if: your land is in a new estate with roads completed and, power (underground pit), sewer point, stormwater discharge and water are available to site and ready for soil testing; your sales paperwork has been completed within 21 days; your land has less that 2 meters of fall over the entire block; you have made no customised structural changes and all options have been selected from the available selection and options lists (ie pre- set options for chosen home design); you agree you cannot make any further changes once New Home Order is signed off; no further client variations will be accepted (with the exception of electrical and colour upgrades made at Edge); you agree to be available for scheduled  appointments as requested between Monday to Friday during standard business hours; you agree to return all required paperwork urgently to ensure work continues without delay; you understand the agreed balance of deposit is required at the contract signing appointment; you understand unconditional finance approval is your responsibility to provide to the builder within 30 days of contract signing date; you understand conditions that can impact on your Site Start Guarantee include the requirement of report and consent, 3rd party delays and non-compliance with any of these conditions. Site Start Guarantee cannot be offered to jobs where land isn’t available; jobs which require town planning; structurally-varied homes; homes in established areas and homes requiring demolition.
