All of which are the property of Burbank Australia (SA) Pty Ltd (“Burbank”) and must not be used, reproduced, copied or varied, wholly or in part without written permission from an authorised Burbank representative. For the avoidance of doubt, the Owner must not use the plans, specification or any other documentation prepared by the Burbank, without its written permission. If the Owner provides its own plans, modifications, changes and / or sketches to Burbank then the Owner warrants that such documents are not in breach of any copyrights law and should they be in breach of any copyright laws the Owner agrees to indemnify Burbank for all loss and/or damages suffered by Burbank.

The price freeze commences on the date you pay your Initial Deposit and gives you 12 months for your:

Guaranteed site start is only applicable if: your land is in a new estate with roads completed and, power (underground pit), sewer point, stormwater discharge and water are available to site and ready for soil testing; your sales paperwork has been completed within 21 days; your land has less that 2 meters of fall over the entire block; you have made no customised structural changes and all options have been selected from the available selection and options lists (i.e. pre- set options for chosen home design); you agree you cannot make any further changes once New Home Estimate is signed off; no further client variations will be accepted (with the exception of electrical and colour upgrades made at the Burbank Edge Selection Studio which must be finalised on the appointment day); you agree to be available for scheduled appointments as requested between Monday to Friday during standard business hours; you agree to return all required paperwork within 48 hours, to ensure work continues without delay; you understand the agreed that the full 5 % balance of deposit is required at the contract signing appointment; you understand unconditional finance approval is your responsibility to provide to the builder within 30 days of contract signing date. You also understand that any 3rd party direction, outside the control of the Builder can impact on your Site Start Guarantee, examples but not limited to : Locial Council, Water Authority or Building Surveyor . FIXED SITE COSTS
It's our policy that once we issue you with your Fixed Site Costs they won’t change unless you or your Land Developer make further changes to your land, the House Design and Facade or the positioning of your home on your block of land.
Site Costs include : Site specific concrete waffle pod slab, as designed by Engineer including if required, deepened edge beams, bored concrete piers up to 450 diameter and up to 3600mm deep or screw pile up to 5000mm deep. Also included if required excavation and removal of rock, re-establishment survey by licensed surveyors and under pinning. Cut and fill as indicated on the proposed levels up to 2000mm of fall over entire block, a driveway gradient no steeper than 1 : 6 from the front boundary to beginning of the garage slab, with 1 step down between the Garage slab and the house (Max of 3 Steps possible ), any required timber sleeper retaining walls and agricultural drains associated with the cut and retaining wall, protection to salinity areas [ if applicable], wind rating N1, front set back of no greater than 6m, all service connections on or within the title boundaries provided by the Owner and no greater than a 10 meter run to stormwater and sewer, gas available to the site, electrical power pit installed and ready for connection to the front boundary.
Fixed Site costs are based on the house design, floor plan options, extensions and upgrades as listed on the New Home Estimate / Proposal at the time the site costs were issued. Any changes made after will void the Fixed Site Costs. Fixed Site Costs are priced using “proposed levels” issued by the developer and supplied to the Builder by the Owner. The Builder has the right to withdrawal or review the offer should significant changes occur after the land is subdivided. Actual site assessment will be confirmed once the land is titled and the Builder receives the soil test, site survey and the engineering reports and designs
Items not included in fixed site costs : Established areas, AHD levels, removal of trees and trees stumps, tree root protection barriers and council requirements and approvals [unless specified] sewer tie depth greater than 1600mm, traffic management, tight and difficult site access, removal of hazardous materials surcharges for exclusion zones, travel surcharges to outer areas, protection notices, fall protection and government surcharges.
