Build Time Guarantee

Get peace of mind with Burbank’s Build Time Guarantee*: if we go over your agreed build time, we will contribute $250 per week towards your living expenses.

*Offer available on new deposits for our standard South Australian Burbank range from 1.4.23 in valid SA build regions. Guaranteed timeframes will be voided by structural variations, sites with fall in excess of 1.5m, and builds requiring split leveling. Site start is considered the completion of slab pour and completion date is at Practical Completion. Contributions will be represented as a contract variation and will be deducted from the final claim. For customised homes with modified or specialised designs, Build Time Guarantee* reverts to HIA contract allowance of 37 weeks and the weekly contribution over that time still applies. 12 Month Price Freeze

The 12 month price freeze commences on the date of the initial deposit date until:

Fixed Site Costs

It's our policy that once we issue you with your Fixed Site Costs they won’t change unless you or your Land Developer make further changes to your land, or you change the House Design, Façade, selected floor plan options, extensions, upgrades as listed on the New Home Estimate / Proposal / Final Tender at the time the site costs were issued or the change to the positioning of your home on your block of land or as directed by the engineers.

Site Costs include : Site specific concrete slab, using “proposed levels” issued by the developer and supplied to the Builder by the Owner, a re-establishment survey by licensed surveyors and cut and fill as indicated on the proposed levels.

Exclusions apply : -

Excavation and removal of rock, fall greater than 2000mm of fall over entire block, a driveway gradient greater than 1 : 6 from the front boundary to beginning of the garage slab.

Note : -The Builder has the right to withdrawal or review the offer should significant changes occur after the land is subdivided. Actual site assessment will be confirmed once the land is titled and the Builder receives the soil test, site survey and the engineering reports and designs.

Guaranteed Site Start

Guaranteed site start is only applicable if: your land is in a new estate with roads completed and, power (underground pit), sewer point, stormwater discharge and water are available to site and ready for soil testing; your sales paperwork has been completed within 21 days; your land has less that 2 meters of fall over the entire block; you have made no customised structural changes and all options have been selected from the available selection and options lists (i.e. pre- set options for chosen home design); you agree you cannot make any further changes once New Home Estimate is signed off; no further client variations will be accepted (with the exception of electrical and colour upgrades made at the Burbank Edge Selection Studio which must be finalised on the appointment day); you agree to be available for scheduled appointments as requested between Monday to Friday during standard business hours; you agree to return all required paperwork within 48 hours, to ensure work continues without delay; you understand the agreed that the full 5 % balance of deposit is required at the contract signing appointment; you understand unconditional finance approval is your responsibility to provide to the builder within 30 days of contract signing date. Our Affiliates are plumbers, electricians, project managers, land developers, resorts business, mortgage brokers, information technology service providers, aviation service providers and storage business providers - among others.

   9. (i) occupation and employment details, including employment status and any previous work experience;

      We also use technology in our display homes and premises from which we operate that tracks foot traffic through our display homes by uniquely identifying mobile phone signals.

      If you do not consent to our collection of this information, you can opt-out by not connecting to our Wi-Fi network or turning off your Wi-Fi when entering our premises.

7. How we hold Personal Information

   We take reasonable steps to protect your Personal Information from misuse, interference and loss and from unauthorised access, modification or disclosure.
   We may hold Personal Information in both hard copy and electronic forms in secure databases on secure premises. The information can only be accessed by those who have a legitimate business purpose and reason to do so.      • for business support purposes including any maintenance, backup and audit;

     • personalising our products and services or those of our Contractors, sub-contractors and suppliers;
     • helping us to manage and enhance goods and services we procure from our Contractors, suppliers and sub-contractors;

   6. (f) auditors and financial advisers;
   7. (g) building surveyors, engineers and other consultants that we engage;
   8. (h) responsible authorities, such as local councils and water authorities;
   9. (i) the Land Titles Office, State Revenue Office, relevant State and Territory Valuers General, Australian Securities and Investment Commission;
   10. (j) real estate agents and sales consultants;
   11. (k) guarantors and other security providers;
   12. (l) valuers;
   13. (m) financiers, potential financiers, credit reporting bodies,
   14. (n) financial institutions and credit providers for the processing of payments and invoices;
   15. (o) referees whose details are provided to us by job applicants or tenants;
   16. (p) our professional service providers or advisers, such as lawyers or accountants;
   17. (q) medical professionals for assessing insurance claims;
   18. (r) any court, tribunal or industry body;

10. Overseas disclosure

    Some of your Personal Information may be disclosed, transferred, stored, processed or used overseas in India by us, our Affiliates or by a third party service providers for the following reasons:

    1. (a) we outsource certain activities (such as drafting and administrative support) to our Affiliates; and
    2. (b) transactions, information, services or products have an overseas connection.

    We will take reasonable steps to ensure the overseas recipient complies with the APPs or is bound by a similar law before we disclose your Personal Information overseas.

Burbank Customer Review Competition

Terms and Conditions

The “Burbank Customer Review” competition is promoted by Burbank Australia Pty Ltd ABN 91 007 099 872 (“Burbank”).

To enter into the competition, entrants who have purchased a home with Burbank must submit a review of Burbank on Product Review between March 1st to May 30th, June 1st to August 31st, September 1st to November 30th, and December 1st to February 28th. By leaving a review within a given quarter, the entrant will go into the draw to win a $1,000 Prezzee E-Gift card (the "Prize"). The Prize is subject to the issuing retailer's general terms and conditions of use for the voucher. 

The competition is open to all Australian citizens over 18 years of age and who have purchased a home with Burbank. The prize cannot be redeemed for cash or goods. If the Prize is unavailable due to the issuing retailer, Burbank (in its discretion) reserves the right to substitute the Prize with a prize of equal value and similar specification.

Incomplete, incorrect or indecipherable entries will invalidate the participant's entry into the competition.

The winners will be selected randomly and drawn at Burbank’s national head office located at 36 Aberdeen Road, Altona and the winners will be notified within three (3) business days from the draw date via email. Burbank reserves the right to ask the winner to prove their identity by seeking identification documents from them. Burbank will send the Prize to the winner by email within 30 days of notification. Energy saving values are an estimate only calculated by Chromagen Australia Pty Ltd (ABN 12 604 330 289) and are not to be relied upon as an exact savings amount.  Customers should make their own enquiries and undertake their own due diligence before installing solar panels. The savings amounts are expressed in AUD, are correct as of January 2021 and are the values applicable to Melbourne set out in the Clean Energy Council’s PV Consumer Guide found at https://bit.ly/3IlFgik and Clean Energy Council's average daily production of a solar power system. These values are based on offsetting a $0.28 cost per kWh and assumes 100% of the solar power generated is consumed by the property, and optimal panel layout with no losses. Energy saving values can differ based on kWh costs, usage patterns, the location of the home and relevant distributor restrictions. 

Burbank to plant 5,000 native trees planted by 2027 - Burbank is dedicated to planting 5,000 native trees by 2027.  Burbank aims to achieve this in conjunction with their Green Partner Carbon Neutral and its Yarra Yarra Biodiversity Corridor – Plant-a-Tree Program – Australia. Offset your build offering- Burbank’s Carbon Offset Your Build program is a voluntary contribution that Burbank’s customers can elect to make.  The amount will include a Goods and Services Tax (GST) component, which will not be allocated towards carbon offset projects.  The amount will be calculated at the time of estimate, however the offset is subject to change in the future which may reduce the total carbon offset effect. The calculation method provides an emission estimate only and should not be relied upon as an accurate record of the actual emissions.  The estimate is based on a carbon life cycle assessment benchmark average on Burbank’s best-selling homes. Equivalent estimates are derived from https://www.epa.gov/energy/greenhouse-gases-equivalenciescalculator-calculations-and-references. Burbank accepts no liability if the calculation of greenhouse gas emissions relating to your specific home build is incorrect or inaccurately reflects actual greenhouse gas emissions attributable to your home and future energy use. All calculations are based on industry standard figures, along with climate zone information specific to the region and average occupants. A homes exact lot address, orientation on the lot and inclusions within the house will vary results. While Burbank has taken reasonable care to ensure the information provided on websites and estimates relating to carbon offsetting is correct, all information is subject to change at any time without notice. Burbank reserves the right to suspend or terminate this offer at any time without notice and is subject to any applicable legislative or regulatory controls imposed now or in the future.

Swift

*The Burbank Swift Process is subject to and conditional upon the following: 1) The customer pays the full initial deposit monies to Burbank Australia Pty Ltd (‘Burbank’) and completes all paperwork required by Burbank; 2) the property is expected to have its own respective certificate of title within twelve (12) months from the date of when the initial deposit is paid and; 3) the property is located in an estate that accepts the Swift home design the customer has selected.
