If the Owner provides its own plans, modifications, changes and / or sketches to Burbank then the Owner warrants that such documents are not in breach of any copyrights law and should they be in breach of any copyright laws the Owner agrees to indemnify Burbank for all loss and/or damages suffered by Burbank.

Burbank is confident to provide the original owner with a 30-year structural guarantee from the date of Occupancy Permit.
This is a special thank you to you for choosing Burbank and is not transferable to any subsequent purchaser or successors in title. Any structural defect caused by one or more of the following events are not included in the structural guarantee: storms, fire, or flooding; trees growing near your slab; fair wear and tear; misuse or neglect failure to maintain the home, movement due to shrinking evidenced by minor cracking; failure to maintain termite protection; any structural modification/s made to the existing home after handover will void the 30-year structural guarantee. Structural failure is defined as in the Building Code of Australia and relevant Australian Standards, including AS 1684, 2870 and 4773 and is damage that is considered category 3 or above.
The “Burbank Customer Review” competition is promoted by Burbank Australia Pty Ltd ABN 91 007 099 872 (“Burbank”).
To enter into the competition, entrants must submit a review of Burbank on Google or Product Review between March 1st 2022 and May 31st 2022; June 1st 2022 and August 31st 2022 or September 1st 2022 and November 30th 2022, December 1st 2022 and February 28th, 2023. Offset your build offering- Burbank’s Carbon Offset Your Build program is a voluntary contribution that Burbank’s customers can elect to make. The amount will include a Goods and Services Tax (GST) component, which will not be allocated towards carbon offset projects. The amount will be calculated at the time of estimate, however the offset is subject to change in the future which may reduce the total carbon offset effect. The calculation method provides an emission estimate only and should not be relied upon as an accurate record of the actual emissions. The 12 month price freeze commences from your initial deposit date until site start* based on:
1) The registration of the title or
2) Demolition works being completed (including receipts of Asbestos Clearance Certificate) or
3) Issuing of planning permits (being receipt of endorsed plans)
within 8 months of the initial deposit date.
If the applicable items above are not completed within 8 months of the New Home Estimated Printed Date, Burbank Australia Pty Ltd is entitled to issue a price rise. If your title is registered and / or no planning and no demolition is required, the price freeze does not apply as you will receive priority status. CDB-U-52603.
*Site Start is when you receive a letter from Burbank confirming your job has been referred to the construction department.
If the dwelling is a Burbank standard design and does not include floor plan option(s) and/ or upgrade(s), and the neighbouring dwellings are equal to or lesser height to the design selected, we guarantee that the dwelling will achieve a minimum of a 6-Star Energy Rating at no additional cost to the Owner.
Where the Customer has selected any standard structural floor plan option(s), standard upgrade(s) or altered the standard design in any way, and the neighbouring dwellings are equal to or lesser height to the design selected, this will impact on the energy rating and additional costs will be incurred to achieve the minimum 6 Star energy rating required for compliance. Final costs can only be determined upon receipt of the energy rating report prior to Building Permit being issued. All adjustment will made in the form of a variation.
The Burbank Swift Collection is subject to and conditional upon the following: 1) The customer pays the full initial deposit monies to Burbank Australia Pty Ltd (‘Burbank’) and completes all paper works required by Burbank; 2) the property is expected to have its own respective certificate of title within twelve (12) months from the date of when the initial deposit is paid and; 3) the property is located in an estate that accepts the Swift home design the customer has selected. The list of estates accepting of the Burbank Swift Collection is extensive and is available at all Burbank VIC display offices. Display office locations are available to view at www.burbank.com.au/victoria/display-homes. The ‘7 business days to contract’ guarantee will come into effect once all required paperwork has been approved and accepted by Burbank’s state Operations team. Once paperwork and customer’s file has been accepted by Burbank’s state Operations team, the customer will be issued their building contract within seven (7) business days.
